Privacy Notice

Liz Lerman LLC (the "Company", "we", "our", or "us") respects your privacy. This Privacy Notice describes the information we collect when you visit lizlerman.com and its affiliated subdomains (the "Site"), create an account, purchase or use our online courses and related educational materials (the "Services"), subscribe to our email communications, or contact us. Our Terms of Service are available through the Site footer. A separately contracted workshop or other engagement may have additional disclosures appropriate to that engagement.

This Privacy Notice applies to information we collect:

  • From visitors to the Site, account holders, course participants, and purchasers (collectively, "you").
  • When you register for an account, purchase a course, or use the Services.
  • In contact-form submissions, email, and other electronic communications between us.
  • When you subscribe to newsletters or request information about our programs, workshops, or other offerings.

The Services may provide links to non-Company websites, services, or social networks. Those third parties have their own privacy practices. Review their privacy notices before providing information to them. Our use of service providers and tracking technologies on our Site is described below.

We may update this Privacy Notice and will post the revised notice on the Site with an updated date. For a material change, we will provide a prominent notice on the Site or any additional notice required by applicable law. We will obtain consent before using previously collected information for a materially different purpose when applicable law requires it. Changes do not retroactively override your existing privacy choices.

I. THE TYPES OF INFORMATION WE COLLECT

A. Personal Information

"Personal Information" means information that identifies, relates to, describes, or can reasonably be linked to you or your household, directly or indirectly. It includes online identifiers and information about your interactions with our Site, not just your name and contact details.

We collect your first and last name, email address, username and account authentication information, billing address, Internet Protocol (IP) address, purchase information, and information about your browsing, searches, and interactions with the Site. Payment information is collected through Stripe as explained in Section I.C. We do not request your date of birth, age, sex, marital status, Social Security number, health information, or educational records.

We collect information directly when you register, purchase, subscribe, or contact us, and automatically through Site operations, Google Analytics 4 ("GA4"), and Meta Pixel. We also receive transaction information from Stripe and communication information from Mailchimp in connection with their services for us. Please do not submit sensitive information that is unnecessary for your inquiry.

B. Registration and Transactional Data

You may browse the public Site without an account. To purchase and access a course, you register through our WordPress site, which uses LearnDash to provide course access. We maintain your registration details, account identifiers, enrollment and access information, purchase records, video progress, lessons completed, and certificates awarded.

You can change your username and password through your account. Keep your password confidential and use a unique password. If you believe your account has been compromised, notify us at info@lizlerman.com and change your password promptly. These precautions do not limit our obligations to safeguard Personal Information.

Your account may associate your real name with your username. The Site does not currently offer public user posts, chat rooms, discussion boards, or forums.

C. Payment Information

We use Stripe to process payments. Payment card or bank-account details and related authentication information are entered through Stripe. Stripe stores payment information after a transaction, subject to its own retention practices and legal obligations. We receive information needed to administer your order and payment, such as billing details, payment status, transaction identifiers, and the payment-method information made available through our Stripe account.

Authorized Company personnel manage our Stripe account, and our website developer may receive temporary access for technical support. Stripe also processes certain information for its own payment, security, fraud-prevention, and legal-compliance purposes. Its privacy policy is available at https://stripe.com/privacy. Contact us about your course or order; you may also contact Stripe about processing for which it is independently responsible.

D. Contact Us Information and Feedback

When you submit a question, comment, request, or feedback through our contact form or by email, we collect the information you choose to provide, including your name, email address, message, and attachments. Our public contact form also allows you to provide a phone number, organization or university, website, postal address, and details about a proposed engagement, including timing, audience, and budget. We use those details to respond to and administer your inquiry; providing a phone number is not consent to marketing calls or texts. Our designated staff monitor the info@lizlerman.com inbox.

E. Computer and Device Information

When you access the Site, we and the providers described below collect IP addresses, browser and device information, online identifiers, referring pages, pages viewed, and information about searches and interactions with the Site. This information can indicate your approximate location; we do not request precise device-location permissions. Tracking choices are explained in Section III.C.

F. Cookies, Analytics, and Meta Tracking

Cookies are small files stored on your device. We use cookies and similar technologies for account sessions and course access, site-usage measurement, and marketing. Session cookies expire when a session ends; persistent cookies remain until they expire or are deleted. Our use of GA4 and Meta technologies may involve persistent identifiers as well as session cookies. A current list of the cookies used on the Site, including their purposes and durations, is available in our Cookie Policy.

Google Analytics 4. We use GA4 to understand general Site usage, traffic patterns, and interactions. Google receives information generated by the analytics technology, including online identifiers and information about Site activity. Google explains its processing at https://policies.google.com/technologies/partner-sites. Analytics information is Personal Information when it can reasonably be linked to an individual, even if our reports are presented in aggregate.

Meta Pixel. We use the Meta Pixel in connection with marketing and measuring interactions with the Site. The Pixel sends Meta information about Site visits and actions, together with device and online identifiers. Meta may associate that information with a Meta account and use it for advertising and measurement across services, as described in its privacy policy at https://www.facebook.com/privacy/policy/.

We do not sell customer lists for money. However, disclosures to Meta for cross-context behavioral advertising may constitute "sharing," a "sale," or processing for targeted advertising under applicable privacy laws, even when no money is paid for the information. Your choices are described in Section III.C.

II. HOW WE USE AND SHARE INFORMATION

A. Provide Our Services

We use WordPress and a custom LearnDash-powered website to operate the Site and provide course access. Account information is stored in our WordPress environment. Our hosting and technical service providers may process that information to host, secure, maintain, and troubleshoot the Site.

We use Personal Information to create and administer accounts, provide purchased course access, process transactions through Stripe, respond to requests, personalize the onsite experience and relevant offerings, and send service-related communications. Necessary account and transaction information is required to provide the corresponding Services; optional marketing consent is not required to purchase or access a course.

We disclose relevant Personal Information to providers that support these activities, including Stripe for payment processing; Mailchimp for email lists, newsletter delivery, and subscription preferences; Google for GA4; Meta for the Pixel; and our website hosting, development, and support providers. The processing by Google and Meta is further described in Section I.F.

Authorized staff and contractors may access information needed for their work, including Grounded Growth Marketing for email and marketing support and our website developer for technical support. We require providers and contractors acting on our behalf to use Personal Information only for the services they provide to us, to protect it, and to comply with the data-protection terms that apply to them. Some providers, including Stripe and Meta, also act independently for purposes described in their own notices.

B. Email Communications

We use email to communicate with you about purchases, account access, support requests, and changes affecting the Services. We also use Mailchimp to send newsletters and promotional messages about our offerings, consistent with your preferences and applicable consent requirements. We do not currently send text messages or conduct telephone marketing.

You may unsubscribe from marketing messages using the link in each message or by emailing info@lizlerman.com. Unsubscribing does not prevent necessary non-marketing messages about your account, purchase, or a request you have made.

C. Usage Measurement and Aggregate Reporting

We use GA4 and related Site-usage information to understand general usage patterns and trends and to support the onsite experience described above. We may report aggregate, non-identifying information to funders or potential funders. Such reports are not intended to identify individual users, and we do not attempt to reidentify information we have deidentified.

We do not use Personal Information for a separate testing, research, or product-development program, or to train artificial intelligence models. Our current online course is not an AI-powered service, and we do not use automated decision-making that produces legal or similarly significant effects on you. Any future materially different use will require appropriate notice and any legally required consent before it begins.

D. Marketing Purposes

We use your contact information to provide newsletters and relevant information about our programs, subject to your communication preferences. Marketing permission is separate from accepting the Terms of Service. We obtain consent where required and provide the ability to withdraw it. We will not publish your name, likeness, or identifiable feedback as a testimonial without your permission.

We use the Meta Pixel for marketing and measurement as described in Section I.F. We limit these activities according to your tracking choices and applicable law. Opting out of marketing emails does not automatically change your browser tracking choices, and changing tracking choices does not automatically unsubscribe you from email.

E. Legal Requirements

We may disclose Personal Information when reasonably necessary and permitted by applicable law:

(a) to comply with law or valid legal process, including a lawful subpoena, warrant, or court order;

(b) to enforce our Terms of Service or another applicable agreement, including collecting amounts properly owed;

(c) to protect the rights, property, security, or safety of the Company, our users, or others, and to address fraud, abuse, or unlawful activity; or

(d) to respond to an emergency involving a risk of death or serious physical injury, when disclosure is legally permitted.

F. Business Transfers

Personal Information may be disclosed in connection with a proposed or completed merger, acquisition, financing, reorganization, or transfer of all or part of our business, subject to appropriate confidentiality and data-protection safeguards. Any successor must handle the information consistently with applicable law and the protections applicable to it. A business transfer does not eliminate your privacy rights.

G. Legal Bases for European Processing

Where the EU or UK GDPR applies, we rely on: our contract with you for registration, payment, and course access; our legitimate interests for answering inquiries, operating and securing the Site, keeping business records, and enforcing our agreements where those interests do not override your rights; legal obligations for required accounting, regulatory, and privacy-request records; and your consent for optional tracking and marketing. You may object to processing based on legitimate interests and may withdraw consent at any time. Withdrawal does not affect processing that was lawful before withdrawal. Without information needed for an account or purchase, we may be unable to provide the course.

III. HOW YOU CAN MANAGE YOUR INFORMATION

You may choose not to provide information requested by us. Some information is necessary to create an account, complete a purchase, or respond to a request, but optional tracking and marketing choices do not determine whether you can buy a course.

A. Account Settings

You can change your username and password through the account area. You can change marketing preferences through the links in our emails. For other account information or assistance, contact info@lizlerman.com.

B. Request Changes or Deletion

You can request access to, correction of, or deletion of your Personal Information by emailing info@lizlerman.com. Sections V and VI explain additional rights and how we handle requests.

We may retain information needed to complete a transaction, satisfy legal obligations, address disputes, prevent fraud, or maintain a record of your privacy choices, as permitted by applicable law. Deleting information required to operate your account may prevent further account access; we will explain that consequence before acting where appropriate. This does not waive a refund or other remedy required by law.

C. Cookie Choices and Online Tracking

Browser settings may also let you block or delete cookies. Blocking necessary cookies may affect login or course access. Your choices may be specific to a browser or device and may need to be renewed after you clear cookies or use another browser. A provider-specific opt-out is supplemental to, and does not replace, the choices we must provide on our Site.

California Do Not Track disclosure. The Site does not currently respond to legacy Do Not Track signals. Legacy Do Not Track settings are different from legally recognized opt-out preference signals such as GPC. Google and Meta may collect information about your activity over time through the Site as described in Section I.F.

D. Links to Other Websites

We may link to third-party resources, including program partners or social media pages. Review the privacy practices of those websites before providing information. This does not limit our responsibility for the providers and tracking technologies that we select for our own Site.

E. Marketing Opt-Out

Use the unsubscribe link in any marketing email, or email info@lizlerman.com, to stop marketing messages. We honor requests within the period required by applicable law and do not charge for opting out. We may retain a limited suppression record to avoid sending further unwanted marketing. Service messages are handled as described in Section II.B.

IV. OTHER INFORMATION ABOUT OUR PRIVACY PRACTICES

A. Security

We use physical, electronic, and administrative safeguards designed to protect Personal Information against unauthorized access, use, alteration, or disclosure. Access is limited according to job responsibilities, including authorized contractors who need access for their services. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Nothing in this Notice disclaims security or breach-notification obligations imposed by law.

Keep your account password confidential and contact us promptly if you suspect unauthorized access. Do not send full payment-card details or other unnecessary sensitive information through email or the contact form.

B. Children

The Site and Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. Children under 13 should not register or submit information. If we learn that we collected such information without legally required parental consent, we will take steps to delete it. Contact info@lizlerman.com if you believe a child has provided information. Account eligibility is described in the Terms of Service; this Notice does not authorize processing of a minor's information without any protection or consent required by applicable law.

C. Retention

We retain Personal Information only as long as reasonably necessary for the purpose for which it was collected and for applicable legal requirements. Account and enrollment information is kept as needed to provide and administer access and resolve related matters. Transaction and billing records are kept for accounting, tax, fraud-prevention, and legal purposes. Inquiries and support correspondence are kept as needed for follow-up or claims. Marketing information is kept while you remain subscribed or otherwise lawfully eligible to receive it, with limited suppression records retained as needed to honor opt-outs. Technical and analytics information is kept for its configured operational period rather than indefinitely by default.

When retention is no longer necessary, we delete or deidentify the information, subject to legally permitted retention and restricted backup cycles. The relevant criteria include the type and sensitivity of information, the duration of your relationship with us, outstanding obligations or disputes, and applicable legal retention periods. Third parties acting independently, such as Stripe for certain payment records, apply their own retention practices, subject to their legal obligations.

D. International Processing

The Company is based in the United States and offers the Services internationally. Information may be processed in the United States and in locations used by our hosting, email, analytics, advertising, and payment providers. Those locations may have different data-protection laws from your location. Where a restricted international transfer requires safeguards, we use a legally permitted mechanism, such as an adequacy decision or appropriate contractual safeguards.

V. PRIVACY RIGHTS

A. Categories, Sources, and Disclosures

The information and choices described in this Notice apply to our Site users. Additional statutory rights depend on your location and whether the relevant privacy law applies to our processing.

The categories we process include identifiers and contact information; account credentials; customer-record information, including billing details; commercial information about purchases and enrollments; internet and network activity; approximate location inferred from an IP address; and information you voluntarily provide in inquiries. Credentials and financial information may be treated as sensitive information under applicable law.

We collect these categories directly from you, automatically through the Site, and from the providers described in Section I. Their purposes and recipients are described in Section II; retention is addressed in Section IV.C. We use credentials and financial information for account access, transactions, security, and related legal requirements, not to infer sensitive characteristics. We do not request precise geolocation, biometrics, or health information.

We do not sell customer lists for money. The advertising disclosures discussed in Section I.F may nevertheless fall within statutory definitions of sale, sharing, or targeted advertising. The tracking choices in Section III.C apply to those disclosures. Any processing of minors' information remains subject to applicable age-specific restrictions, including restrictions on sale, sharing, and targeted advertising.

B. U.S. State Privacy Rights

To the extent the applicable law covers you and our processing, you may have the following rights, subject to that law's conditions and exceptions:

Access and portability. Confirm whether we process your Personal Information; obtain access to it and a copy in a portable, usable format; and obtain information about the categories, sources, purposes, and recipients of processing.

Correction and deletion. Correct inaccurate information and request deletion of Personal Information, subject to permitted retention and other legal exceptions.

Disclosure of recipients. Obtain information about specific third parties or categories of third parties receiving your information where the applicable law provides that right.

Opt-out. Opt out of sale, sharing, targeted advertising, or profiling in furtherance of decisions producing legal or similarly significant effects, where applicable. The Company does not currently conduct that significant-decision profiling.

Sensitive information and consent. Limit certain uses and disclosures of sensitive information, withdraw consent, or decline processing that requires your consent, where provided by law.

Appeal. Appeal a refusal to act on your request by replying to our decision or emailing info@lizlerman.com with "Privacy Appeal" in the subject line. We will explain the result and any applicable route to contact your state attorney general or privacy regulator.

Non-discrimination. We will not unlawfully discriminate or retaliate against you for exercising a privacy right. A request may affect a Service where the information is necessary to provide it, as explained in Section III.B.

You may use an authorized agent where applicable law permits. We may seek proof of authority and proportionate identity verification for access, correction, or deletion.

C. European and Other International Rights

Where the EU or UK GDPR applies, you have the right to access, correct, erase, restrict, or receive a portable copy of your Personal Information; to object to processing based on legitimate interests; and to withdraw consent. You may object to direct marketing at any time. You may also complain to the competent supervisory authority, including the authority where you live or work or where an alleged infringement occurred; in the UK, this is the Information Commissioner's Office. You do not have to contact us before doing so. Swiss and other national privacy laws may provide similar or additional rights. We apply the law that governs the request rather than using U.S. deadlines or exceptions universally.

The Company is the controller of the processing described in this Notice, except where a provider processes information independently for its own stated purposes.

VI. EXERCISING YOUR RIGHTS

A. Submitting a Request

Email info@lizlerman.com to submit a privacy request or complaint. Identify the right you wish to exercise and provide information reasonably sufficient to locate the relevant records, ordinarily your name and the email associated with your account or interaction. You do not need an account to submit a request. Do not send a password or a full payment-card or bank-account number.

An authorized agent may contact us on your behalf, with evidence of your authorization where required. Tracking opt-outs can also be made through the choices described in Section III.C. We will not require verification that is inappropriate for the kind of request.

We use information provided to verify or administer a request only for that purpose and related security or compliance needs. We may request clarification when reasonably needed and permitted by law.

B. Responses and Verification

We verify identity when reasonably necessary to protect your information and as permitted by applicable law. If we cannot act on your request, we will explain why and how to appeal. We respond within the deadline set by the law that applies to you. Under most U.S. state privacy laws that is 45 days, and under the EU or UK GDPR it is one month. Each allows a limited extension, and we will tell you if we need one. Opt-out requests are handled sooner.

We normally respond using the email address associated with your request or another reasonably secure method appropriate to the information. Where legally required, we will provide an available alternative format or delivery method.

A response will cover the period and information required by applicable law. A portable copy will be provided in a readily usable format when that right applies. Any denial will identify the reason and applicable next steps.

Requests are generally free. We may charge a reasonable fee or decline a request only when the applicable law permits it, and we will explain the basis before charging a fee. We do not impose a universal two-requests-per-year limit, except where the applicable law provides otherwise.

C. Complaints

You may complain about how we handle your information by emailing info@lizlerman.com. We will acknowledge the complaint within 30 days, investigate it, keep you informed, and tell you the outcome. This is separate from the deadline for an access, correction, or deletion request. You may also contact your data protection authority at any time without first contacting us.
